Welcome to PISTA PILOT s.r.o. ("we," "us," or "our"). These Terms and Conditions govern your use of our website, e-shop, and Android application (collectively referred to as the "Services"). By accessing or using our Services, you agree to these Terms and Conditions. If you do not agree, please refrain from using our Services.

2. Business Terms

Governing the Purchase Agreement
  • These Terms and Conditions regulate the terms of the purchase agreement and form its integral part. Divergent provisions in the purchase agreement take precedence over these Terms and Conditions.
  • Relationships between the seller and buyer not explicitly governed by these Terms are subject to Czech law, especially Act No. 89/2012 Coll., the Civil Code.
  • Disputes arising from the purchase agreement are subject to the jurisdiction of the court according to the seller's registered office.

3. Orders, Payments, and Taxes

Placing Orders
  • By placing an order, you agree to provide accurate and complete information. Failure to do so may result in delays or the inability to process your order.
  • All orders are subject to availability and confirmation of the order price.
Payment Methods
  • Payments can be made via Stripe, PayPal, Apple Pay, or bank transfer. All payment methods are subject to their respective terms and conditions.
VAT, Customs, and Import Duties
  • VAT: All purchases to EU consumers are subject to VAT in their respective countries. Purchases to EU-based businesses are VAT-exempt if a valid VAT number is provided and verified during checkout. Purchases outside the EU are VAT-exempt but may be subject to import duties and local taxes, which the buyer is responsible for covering.
  • Errors and Omissions: Errors in VAT calculations or product descriptions are subject to correction. We will notify customers of any discrepancies promptly.
Errors and Omissions
  • We reserve the right to correct any typographical errors, inaccuracies, or omissions, including after an order has been placed. Customers will be notified of such corrections promptly.

4. Shipping, Delivery, and Returns

Delivery Terms
  • Orders are typically dispatched within six weeks unless otherwise agreed upon. Partial deliveries may occur, and buyers are obligated to accept them.
  • The goods are considered delivered when handed over to the buyer or a third-party carrier for transportation.
Place of Delivery
  • The seller shall arrange the shipment of goods to the address specified by the buyer. The seller is not responsible for delays caused by inaccurate delivery information provided by the buyer.
Returns and Refunds
  • Products can be returned within 14 days in their original condition. Returns for custom-made items or those used in racing conditions are not accepted.
  • Refunds are processed within 14 days after receiving returned items.
  • Refer to the Withdrawal Notice Form at the end of this document for details on how to withdraw.

5. Warranty and Liability

Warranty Terms

5.1. EU Consumer Warranty: Defect warranty in the statutory scope is provided to consumers residing in the EU, i.e., a 2-year warranty for defects existing upon delivery of an Item to the shipping address provided during check-out and manifesting within that period. This warranty does not apply to software and batteries (see below).

5.2. Limited Business and Non-EU Warranty: Limited warranty is provided to businesses (whether located outside or within the EU) and consumers residing outside the EU for defects existing upon completion of the purchase that shall manifest within 12 months following the dispatch of the Items to the shipping address provided during check-out.

5.3. Batteries Warranty: A limited 6-month warranty is provided for batteries included in an Item or sold separately.

5.4. Scope of Warranty: Our warranty only covers defects that preclude the use of an Item for its intended purpose. Cosmetic defects (e.g., discoloration, paint fading, rust) that do not hinder functionality are excluded.

5.5. Adherence to Instructions: Our warranty is subject to adhering to manuals and use instructions published on our website at www.pistapilot.com/manuals. Misuse or lack of maintenance voids the warranty.

5.6. Exclusions: No warranty is provided for software, including the PISTA PILOT application, which is provided "as is." We disclaim any responsibility for its functionality or performance.

5.7. External Forces: No warranty is provided for defects occurring due to external forces such as abrasion, shock, water, pressure, vibration, or UV light.

5.8. Racing Use: Items used for racing purposes are excluded from enforceable warranties. However, the seller, in good faith, will strive to resolve any defects or issues to minimize costs for the buyer.

5.9. Warranty Process: Items subject to warranty claims, including a detailed written description of the defect, must be delivered for inspection to the address of our seat or another address published for that purpose on our website.

5.10. Warranty Remedies: In case of defects covered by our warranty, you shall be entitled to:

  1. Repair, if repair is economical;
  2. Adequate purchase price reduction;
  3. Replacement of the defective Item.

5.11. Seller's Choice: We may always choose to replace a defective Item instead of carrying out a repair or providing a price reduction.

5.12. Response Time: Your warranty claim shall be reviewed and responded to within 30 days following the delivery of the defective Items to the returns address.

6. Safety

6.1. Unless explicitly stated for a specific Item otherwise, no testing or homologation procedures were taken to ensure compliance with regulations associated with using the Items in regular traffic – on the streets. Use at your own risk.

6.2. Make sure that Items with sharp edges are positioned so that the sharp edge does not face the rider. Always dismount Items, which you are not currently using – especially empty holders and brackets (which may form a sharp edge, when empty).

6.3. Even if the Items are mounted to your vehicle properly, you might suffer an injury to your body (bruises, tearing, fractures, etc.) or damage to your gear (tearing, breakage, etc.), especially in case of an accident (e.g., dismounting your vehicle in other than the standard way).

6.4. Items are intended for use on closed racing tracks only and at the buyer's risk. The seller is not responsible for any damages, including injuries, death, psychological harm, property damage, loss, or liability resulting from the use or purchase of the Items.

7. Use Instructions

  • Manuals and use instructions are only provided in electronic form and can be downloaded from our website at www.pistapilot.com/manuals.
  • Manuals assume basic technical proficiency. In case of doubt, professional installation is recommended.
  • Manuals and technical support are provided only in the English language.

8. Communication

  • The official language of this agreement is English.

9. Governing Law and Dispute Resolution

  • These Terms are governed by Czech law. Disputes will be resolved through mediation whenever possible before escalating to court proceedings in Prague, Czech Republic.

10. Additional Provisions

Custom Orders
  • Custom-made products are non-returnable and non-refundable.
Environmental Responsibility
  • PISTA PILOT is committed to sustainability. Where possible, we use eco-friendly materials and packaging.
Limitation of Liability
  • We are not responsible for indirect or consequential damages arising from the use of our products or Services. Use is at your own risk.
